The terms governing your use of this site, the research library, and 1:1 calls with Mark Di Paola.
These Terms of Service ("Terms") govern your access to and use of moneymarketsmayhem.com (the "Site") and any products, research, podcasts, and services offered through it, including downloadable reports and 1:1 calls (collectively, the "Services") provided by Mark Di Paola ("we", "us", "our"). By using the Site or purchasing any Services you agree to these Terms.
Everything on this Site — including reports, blog posts, newsletter content, podcast episodes, social posts, and 1:1 call discussions — is general information and commentary for educational and discussion purposes only. It does not take into account your objectives, financial situation, or needs, and it is not personal financial product advice within the meaning of the Corporations Act 2001 (Cth), tax advice, legal advice, or any other form of professional advice.
Mark Di Paola and Money, Markets & Mayhem do not hold an Australian Financial Services Licence (AFSL) and are not authorised representatives of an AFSL holder.
Before acting on anything you read, watch, or hear from us, you should:
You make your own decisions about your money. Markets carry risk. Past performance is not a reliable indicator of future performance. You may lose some or all of any capital you put at risk.
Reports purchased through the Site are licensed, not sold. By purchasing a report you receive a non-exclusive, non-transferable, revocable licence to download and use the report for your own personal, non-commercial reference.
You may not:
Reports reflect our research and opinion at the time of writing. Markets and conditions change. We may update reports without notice but are not obliged to.
A 1:1 call is a sixty-minute conversation with Mark to help you sharpen a market question you are working through — a theme, a thesis, a macro setup, or a research process. Calls are general information only. Calls do not include and we will not provide:
Recordings of the call are not provided unless agreed in writing before the call. You may take your own notes for personal reference. Sharing or publishing recordings, transcripts, or substantive excerpts of the call without our written consent is prohibited.
Prices are displayed on the Site at the time of purchase and charged in US Dollars (USD). AUD and BTC amounts shown are indicative conversions at the prevailing rate at the time of display and may differ from the rate applied at checkout.
Card payments are processed by Stripe. Bitcoin payments are processed by NowPayments. We do not see, handle, or store your payment card details or wallet credentials. Your use of those payment processors is also subject to their terms.
Our refund and cancellation rules are set out in our Refund Policy, which forms part of these Terms.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or other consumer protection laws that cannot lawfully be excluded.
All content on this Site — including reports, articles, podcasts, video, frameworks, branding, and design — is the intellectual property of Mark Di Paola or licensed to us, and is protected by Australian and international copyright and trade mark law. You receive only the licences expressly granted in these Terms.
If you submit your email address — whether through the newsletter signup, a "notify me" form, or as part of a booking — you may receive transactional emails (relating to the purchase or booking) and, where you have opted in, marketing emails from us. You can unsubscribe from marketing emails at any time via the link in every email or by contacting us. Transactional emails (e.g. booking confirmations, receipts) are sent regardless of marketing opt-in status, as permitted by the Spam Act 2003 (Cth).
You agree not to:
The Site uses third-party providers including Stripe (payments), NowPayments (Bitcoin), Cal.com (scheduling), Resend (transactional email), beehiiv (newsletter), Vercel (hosting), and Google's YouTube Data API (public video metadata). These providers process data subject to their own terms and privacy policies. We are not responsible for the content, availability, or practices of any third-party site we link to.
Subject to consumer rights that cannot be excluded by law, the Site and Services are provided on an "as is" and "as available" basis. We make no warranty that the Site or Services will be uninterrupted, error-free, secure, or free of viruses, or that the content is accurate, complete, current, or fit for any particular purpose.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive loss or damage, or for any loss of profits, revenue, savings, data, goodwill, or opportunity, arising out of or in connection with your use of the Site or Services, or any decision you make in reliance on anything on this Site.
Where liability cannot be excluded but can be limited, our total aggregate liability to you for any claim arising out of or in connection with the Services is limited, at our option, to: (a) re-supplying the Services; or (b) refunding the amount you paid to us for the Service that gave rise to the claim.
We may amend these Terms from time to time. The "Last updated" date at the top of this page will reflect the most recent change. Material changes will be flagged via the newsletter or on the Site. Continued use of the Site after a change constitutes acceptance of the revised Terms.
These Terms are governed by the laws of New South Wales, Australia. Each party submits to the non-exclusive jurisdiction of the courts of New South Wales for any dispute arising out of or in connection with these Terms.
